ARTICLE 1- ORGANISER OF THE COMPETITION

The Peugeot Motor Company, a limited company with capital of €172,711,770, with its registered office in Paris (75116) - France, 75 avenue de la Grande Armée,
the registration number of which with the Companies Register is 552 144 503 (hereinafter referred to as the "Organising Company" and/or Automobiles Peugeot) is organising, in Metropolitan France (including Corsica), Switzerland, Germany, Italy, Slovakia, the United Kingdom, Austria, the Netherlands, Slovenia, Bulgaria and Croatia, a Competition with no purchase necessary under the name "308 - Show your true character" running from 17th May 2011 to 14th June 2011 inclusive, hereinafter referred to as "the Competition". The Competition can be accessed at the following internet address (URL): http://www.308character.peugeot.co.uk and offers the chance to win your portrait taken by the photographer Xavier Lambours, a French photographer renowned for his portraits, during a photo shoot in Paris under the conditions described in article 6 below,

ARTICLE 2 - COMPETITION CONDITIONS OF ENTRY

The competition is open to all adults having full legal capacity to enter this Competition and resident in one of the countries mentioned previously in article 1 above.

In this context, it is specified that members of the personnel of the Organising Company and more generally of the PSA PEUGEOT CITROEN Group may enter, providing they use their personal internet address. Any entry by these latter from their professional address will be considered null and void.

 

ARTICLE 3 - General principle of the COMPETITION

The general principle of the Competition consists of submitting a photo representing the entrant together with 3 (three) adjectives describing the entrant's character and with reference to the theme of the communication campaign concerning Automobiles Peugeot's 308, which consists of affirming its character. When selecting the winners, particular attention will be paid to the appropriateness of the photos and adjectives in relation to the theme of the campaign.

ARTICLE 4 - COMPETITION ENTRY PROCEDURES

4.1 - To enter this Competition, each entrant simply has to:

1)  have a valid Facebook account in order to use the "Like" function and share his participation with his friends on the Facebook wall.
2) go to the Competition's website (varies according to country)
3)  take part by:

  • clicking on the "Enter" button then, by uploading a photo of himself, entering his first name, his country of residence, 3 adjectives describing his character and suited to the campaign mentioned above, hereinafter referred to as "the Contribution", his surname, his valid email address.
  • accepting the rules of the Competition, by ticking the box "I accept the conditions of entry" and reading and accepting the regulations
  • confirming his availability during the periods specified for the photo shoot which will take place on Tuesday 21st or Wednesday 22nd June 2011 in Paris, implying full availability to travel to Paris between the afternoon of Monday 20th June and the morning of Thursday 23rd June, by ticking the box "I confirm that I am available for a photo shoot in Paris and authorised and able to travel to Paris between 12.00 CET on Monday 20th June 2011 and 20.00 CET on Wednesday 23rd June 2011"

 

4. Validate the entry form, duly completed, at the latest by the closing date for entries, ticking the box by means of which the entrant accepts all these rules distributed in his language, the code of ethics in force on the Internet and the laws and regulations applicable to competitions.

Any forms which are incomplete, incorrect and/or validated by Internet after this time will be considered null and void. In the same way, any participation in this Competition by a person who does not fulfil the conditions required for entry will be considered null and void.

Any conduct on the part of an entrant which could harm the image of the Organising Company and/or which goes against public order and/or morality may result in the participation of the said entrant in the Competition being invalidated.

4.2 - To vote for an entrant, each surfer simply has to:

1)  have a valid Facebook account in order to use the "Like" function and share his participation with his friends on the Facebook wall.

2) go to the Competition's website (varies according to country)

3)  select the photo of his choice and click on "Like"

A surfer may vote for as many Contributions as he likes, but only once for each Contribution.

The voting system consists of allocating a "like" to the selected Contribution.

After the vote, all the "Likes" will be counted and each surfer will be able to see the number of "likes" for each of the Contributions.

ARTICLE 5 - PROCEDURE FOR SELECTING THE WINNER

An a posteriori filtering procedure will be put in place for all the Contributions. This filtering procedure aims to eliminate Contributions which do not fulfil the following prerequisites:
- which have nothing to do with the general principle of the Competition
- which include scenes or remarks which are violent or of a pornographic nature and/or more generally any medium including elements that are prohibited or go against public order or morality;
- which use protected images or celebrities
- which include the presence of motor vehicle marques other than the Organising Company.
It is understood that this list is not exhaustive.

The filtering procedure mentioned above is implemented by means of the so-called "Webmaster" Internet moderator of the Organising Company.
Within a maximum period of 1 (one) week following the uploading of the Contribution by the entrant, the Competition entrants will be informed by email whether their Contribution has been published or not in view of the conditions of entry and the prerequisites mentioned above.
It is understood that only the entrants, creators of the Contributions, will see their participation in the Competition maintained.

It is specified that participation in the Competition implies the entrant's authorisation for the Organising Company to use the Contribution and/or the photographic constitutes of the allocation, in accordance with the terms of article 9 below.

The procedure for selecting the winners is the following:

First stage: selection of 308 candidates

On completion of the stage of checking of the Contributions by the Organising Company, the valid Contributions which have not been eliminated will be on line on the Competition website.

Surfers will be able to vote once only, in accordance with the procedures defined in article 4.2 above, on the dates specified in article 1 of these rules for the Contribution(s) of their choice. Each vote gives a "like" to the Contribution. To prevent fraud, it is specified that the cookies of surfers taking part in the vote will be tracked.

The votes will aim to select the 308 (three hundred and eight) Contributions of the Competition, in accordance with the process below:

  • 3 (three) Contributions from each of the countries mentioned in article 1 of these rules with the most "Likes"
  • The other 275 Contributions from all of the countries mentioned in article 1 of these rules with the most "Likes".

These 308 Contributions, the surfers' favourites, according to the process described above, will then be allowed to take part in the second stage of the Competition described below.

Second (and last) stage: selection of the 28 winners

The 308 (three hundred and eight) Contributions chosen in accordance with the process described in the first stage above will then be submitted to the photographer Xavier Lambours, renowned for his portraits, who will choose 28 which in his opinion show the most character.

The 28 winners will be informed of their selection by email or by telephone on 10th June 2011. The submissions of these 28 winners will also be displayed on the Competition website from 14th June 2011.

The selection will include a number of entrants aimed at ensuring the replacement of a selected winner who cannot or does not wish to claim his prize.

ARTICLE 6 - PRIZES

The Competition will have 28 (twenty-eight) identical prizes, that is a total of 28 (twenty-eight) winners for the Competition.

The prize for each of the 28 (twenty-eight) designated winners consists of a photo shoot with the photographer Xavier Lambours, in Paris. The photo shoots will be divided into four half-days of 7 people. Winners whose photo shoot takes place in the morning will arrive during the afternoon of the previous day and will leave in the evening. Winners whose photo shoot is scheduled in the afternoon will arrive in the morning and will leave the following morning.

Each of the 28 (twenty-eight) prizes includes:
- return travel by aeroplane or train, economy class, for the winner from his home town to Paris, France. The Organising Company reserves the right to choose the entrant's mode of transport. Acceptance of the costs of travel by car may be considered on an individual basis on request during organisation of the transport.
- travel, by means of a 308 shuttle system provided by the Organising Company, from the site of arrival to the various stopping places  (Hotel, photo studio, restaurants), up until the return to the airport
- hotel accommodation for one night + continental breakfast for one person in a 3 star hotel in the 5th arrondissement of Paris + dinner for one person in Paris paid for by the Organising Company (estimated value: 600 Euros incl. taxes)
- A 24x30 cm photographic print by Xavier Lambours signed and numbered Artist's Proof (E/An°1) (value 2000 Euros incl. taxes) (hereinafter the "Photo Edition")
- snacks during the half day of the photo shoot

It is understood that all transfers between the winner's home and the airport (or the station if the journey is by train) are not included, nor is anything else which is not expressly mentioned.

The price of each of the 28 (twenty-eight) endowments, has an estimated value, at least to 2700€, excl shuttles run by the Organizer and transportation costs, whose value depends on both conveyance used as the residence of the winner.

 

ARTICLE 7 - INFORMING THE WINNERS

The 28 (twenty-eight) winners will receive confirmation of their selection by electronic means on the day of the announcement on the Competition website.
The Organising Company cannot be held responsible for the sending of emails to an incorrect address due to the negligence of a winner and/or if it is not possible to contact a winner.
The names of the Winners can be obtained on the Competition website, from the dates specified in article 5 above.
No questions by telephone or in writing relating to the list of winners will be answered.

ARTICLE 8 -  PROCEDURES FOR PRESENTING THE PRIZE

The conditions and procedures for presenting the prizes will be specified to each of the winners in the email announcing that they have been named the winner of the Competition.

The prize may not give rise to any dispute of any kind, on the part of the winner, nor to the provision of an equivalent value in currency, nor to it being changed, nor to its replacement or exchange, for any reason.

ARTICLE 9 - TRANSFER OF INTELLECTUAL PROPERTY RIGHTS

9.1 - In relation to the Entrants

All participants in this Competition accept, by taking part, that their Contribution may be included in a communication about the Competition. So, the entrant authorises the Organising Company, free of charge, to mention his Contribution, the image that it represents (the term "image" is understood to refer to all of the attributes of the personality of the person represented in the Contribution, which includes in particular the image and the voice), as well as the name of the creator, in press releases and articles, publicity documents or brochures and to exhibit them on the website of the Organising Companyor in public events of its choice, without any time limit.

All Entrants confirm and guarantee the Organising Company that they are the exclusive and sole creator of the Contribution produced in the context of the Competition and that it does not violate, directly and/or indirectly, any right of a third party, in particular copyright and/or rights to the image of the person represented in the Contribution.

9.2 - In relation to the winner

The winners exclusively authorize the Organising Company and/or any company of PSA Peugeot Citroën, to use, directly or indirectly, their copyright relating to (i) the contribution which they make as part of this game and (ii)) the image that this Contribution represents (the term "image" is understood to refer to all the attributes of the personality of the person represented in the Contribution, which includes in particular their image and their voice), on any medium, in any way and in any form, for the duration of validity of the corresponding rights and in all countries.

This authorisation includes the right of reproduction and representation of the Contribution and photographic prints. The terms of this authorisation shall be specified, if any, in a document ad hoc agreement between the Organiser and the winner.

This authorisation includes the right of reproduction and representation of the Contributions.

This authorisation gives the Organising Company and/or any company of the PSA PEUGEOT CITROËN Group the option of making any changes to the winners' Contributions and photos of the winners that it considers useful.

It is clearly specified that the value of the prize (see article 6 of these rules), obtained by each winner, includes the consideration for the use mentioned above.

In any case, the Organising Company, and/or any company of the PSA PEUGEOT CITROËN Group, remains completely free to use the winners' Contributions, or not.

All winners confirm and guarantee the Organising Company and/or any company of the PSA PEUGEOT CITROËN Group that they are the exclusive and sole creator of the Contribution produced in the context of the Competition and that it does not violate, directly and/or indirectly, any right of a third party, in particular copyright and/or rights to the image of the person represented in the Contribution and it is not bound by an exclusive contract on the use of the image shown on photographic prints.

9.3 -In relation to articles/interviews with the winners

The Organising Company reserves the option to produce or have produced photo articles and/or interviews with the winners.

Should the Organising Company produce an article and/or interviews with the winners, these latter would authorise the Organising Company, by signing an authorisation to use their image, to use, under the conditions of the said authorisation:

  • any articles produced representing the winner(s)
  • any interviews with this(these) latter,
  • their surname, first name, origin, 3 adjectives characteristic of their character and image.

In any case, the Organising Company remains completely free to use, or not, any articles and/or interviews with the winners that it may have produced, including any photographs that it may have taken of the winners.

9.4  Nominative information

The Winner authorises the Organising Company, free of charge, to use for commercial and/or publicity purposes his surname, first name, address, email address and Image in the context of the communication and/or promotion concerning this Competition.

In application of Law n° 78-17 of 6th January 1978 relating to data processing, data files and individual liberties modified by Law n° 2004-801 of 6th August 2004, each entrant is informed and agrees that:
- his personal data communicated in the context of this Competition may be used for purposes of surveys, analyses or in the context of commercial operations by the Organising Company, its subsidiaries, its commercial network and/or any company offering a service on behalf of the Organising Company;
- he has, in accordance with the law referred to above, the right to access, change and remove data that concerns him, by simple request to:

ARTICLE 10 - CHANGES TO COMPETITION DATES

The Organising Company reserves the right to cut short, extend, change or cancel all or part of the Competition, in the event of force majeure of if circumstances beyond its control make this necessary, without accepting any responsibility.

Any decision of the Organising Company and any change to these rules will be the subject of an additional clause filed with the bailiff appointed in article 12 below.

ARTICLE 11 - RESPONSIBILITY

Participation by Internet implies knowledge and acceptance of the characteristics and limits of the internet, particularly as regards the absence of protection of certain data against any re-routing or piracy and risks of contamination by any viruses circulating on the network, the technical performance, the response times for consultation, interrogation or transfer of information, the risks of interruption and more generally, the risks inherent in any internet connection and transmission.

 The Organising Company will not accept any responsibility, without this list being limiting, in the event of incorrect use or an incident linked with the use of the computer, any malfunction of the internet, of the Competition servers, of the telephone line or of any other technical connection preventing the proper running of the competition.

In the same way, the Organising Company will not be held responsible should access to the website and/or its consultation prove difficult or even impossible for the participants. In the event of a technical malfunction of the Competition, the Organising Company reserves the right, if necessary, to invalidate and/or cancel the session of each of the Competitions of the Competition during which the said malfunction takes place. No claims will be accepted.
The Organising Company cannot be held responsible if the data relating to the registration of a participant does not reach it for any reason for which it cannot be held responsible (for example, an internet connection problem due to any reason at the user's end, a temporary failure of our servers for any reason, etc.) or arrive illegible or impossible to process (for example, if the participant has computer equipment or a software environment unsuitable for his registration, etc.)
Consequently, the Organising Company will not be held responsible, in any circumstances, without this list being limiting:

  • For the transmission and/or receipt of any data and/or information by internet
  • For any malfunction of the Internet preventing the proper running/operation of the Competition.
  • For a failure of any reception equipment or of the communication lines
  • For the loss of any paper or electronic mail and, more generally, for the loss of any data
  • For routing problems,
  • For the operation of any software,
  • For any technical and hardware failure that has prevented or limited the possibility of taking part in the Competition and/or each of the Competitions of the Competition.

 

More generally, the Organising Company cannot be held responsible in the event of force majeure or acts of God which are outside its control. Nor can it be held responsible and no action may be taken against it should events occur of the nature of force majeure (strikes, bad weather, etc.) depriving the participants in full or in part of the possibility of taking part in the competition and/or the winner(s) from receiving their prize.

 

You are reminded that participation in this Competition is free. A participant may only enter the Competition once over the duration described in article 1.

ARTICLE 12- RULES OF THE COMPETITION

Participation in the Competition which is the subject of these rules implies, by rights and automatically, acceptance without reservation of the said rules by the participant.

These rules are filed with Maître Béatrice Desagneaux Pautrat - 23 bis rue de Constantinople - 75008 Paris, France.

 

ARTICLE 13 - LANGUAGE AND APPLICABLE LAW

Any difficulties in the interpretation or application of these rules will be settled by the Organising Company.

If these Competition rules are translated into languages other than French and differences appear between these versions and the French version of these rules, the French version alone will prevail.

This Competition is subject to French law.
